Standard Warranty

Trees and shrubs are covered by a one-year warranty.

Perennials have a 60-day warranty.

Annuals, houseplants, herbs, vegetables, fruit and nut trees, and any plants used/kept in containers are not covered under warranty.

For the warranty to be fulfilled, we must be notified when the plant begins to show signs of decline. The plant’s condition will then be inspected by an employee of New Garden Landscaping. Any recommendations they make to improve the declining plant’s health must be attempted before a warranty is issued. Our recommendations may include, but are not limited to

  • Corrective pruning
  • Pesticide or fungicide treatments
  • Supplemental fertilizer applications
  • Remediation of drainage or drought issues

Replacement

The warranty is for one-time replacement only. No Warranty will be fulfilled until the account balance is paid in full.

In the event that a matching item can not be sourced within 30 days, the warrantied item will be replaced by either an available substitute acceptable to the client OR a credit for the retail value of the warrantied item will be given. The warranty does not cover the replacement of additional “matching” plants if a match can’t be sourced.

In some cases, the installation of replacement plant material may be intentionally postponed due to seasonal variables (extreme heat, drought, snow cover, etc.)

Sod/Seeding

There is a 30-day warranty on sod except during the periods of July 1st through August 30th, and December 1st through February 1st. New Garden is not responsible for acts of Mother Nature.

Lawn grass installation work is guaranteed only for proper installation practices, not for the final result. Seeded turf areas are guaranteed to germinate and cover a minimum of 90% of the seeded area when installed in September and October for fescue, and in April, May, and June for Bermuda. 

Erosion or washouts are not New Garden’s responsibility and are not covered under warranty. Additional costs will occur to the owner for New Garden to repair.

Maintenance Customer Extended Warranty

Warranty coverage for trees and shrubs installed by New Garden will be extended to three years, as long as you maintain an active recurring maintenance contract with New Garden Landscaping during that time. Exclusions

Weather-related plant injury or mechanical damage, including but not limited to drought, flooding, ice damage, animal and insect damage, or vandalism, is not covered by the warranty.

Plants determined to be able to be rehabilitated by pesticide/fungicide treatments or corrective pruning will not be covered under warranty. The cost of any recommended treatment or pruning is not covered by warranty.

Plants will not be warrantied before the spring leaf flush.

If, in our professional opinion, the installation area is determined to be affecting plant survival, the same plant will not be offered as a replacement.

Additional Exclusions-Endemic Plant Diseases

Due to the wide incidence of untreatable plant pathogens in the following plant varieties, these varieties will not be covered by warranty for the following conditions:

  • Redbud (Cercis sp.), all varieties - vascular dieback diseases
  • Dogwood (Cornus florida), all varieties - vascular dieback diseases, anthracnose 
  • Boxwood (Buxus sp.), all varieties - Boxwood blight
  • Rose (Rosa sp.), all varieties - Rose rosette disease
  • Rhododendron, all varieties - any disease

This list may change as pathogens emerge or treatments become available.
